DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY

Our Compliance with the Digital Millennium Copyright Act (17 U.S.C. § 512)

STR Planning, LLC ("STR Planning," "Strengthen My Retirement," "we," "us," or "our"), operates this website and related services, including content appearing on STRPlanning.com and StrengthenMyRetirement.com (collectively, the "Site").

We comply with the notice-and-takedown and counter-notification procedures established by the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. We have designated a DMCA Agent and filed the required designation with the U.S. Copyright Office.

Takedown Procedures

If you are a copyright owner or an authorized agent and believe that material on the Site infringes your copyright, you may submit a DMCA-compliant written notification to our Designated Agent.

To be effective under 17 U.S.C. § 512(c)(3), your notification must include all of the following:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed;

  • Identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative list);

  • Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate the material;

  • Information reasonably sufficient to permit us to contact the complaining party (such as an address, telephone number, and email address);

  • A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and

  • A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Important Notice:

​

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing (or was removed or disabled by mistake or misidentification) may be liable for damages, including attorneys' fees.

Upon receipt of a valid DMCA notice, we will:

​

  • Remove or disable access to the allegedly infringing material;

  • Notify the party responsible for the content; and

  • Take reasonable steps consistent with the DMCA.

Email notifications are accepted provided they contain all information required under 17 U.S.C. § 512(c)(3).

Failure to comply with all requirements may result in an invalid notice.

Counter-Notification Procedures

If content you posted was removed or disabled as a result of a DMCA notice and you believe the removal was due to mistake or misidentification, you may submit a counter-notification to our Designated Agent.

A valid counter-notification must include:

​

  • Your physical or electronic signature;

  • Identification of the material that was removed or disabled and the location where it appeared before removal;

  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification;

  • Your name, address, and telephone number; and

  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which STR Planning, LLC is located and that you will accept service of process from the original complaining party.

Upon receipt of a valid counter-notification, we will:

​

  • Forward it to the original complainant; and

  • Restore the material or cease disabling access within fourteen (14) business days, unless the complainant notifies us that a court action has been filed seeking to restrain the alleged infringement.

​

False counter-notifications may subject the claimant to liability under the DMCA.

Repeat Infringer Policy

STR Planning will terminate, in appropriate circumstances and at our discretion, user accounts that are the subject of two (2) or more valid DMCA takedown notices.

​

If content is removed and later restored following a valid counter-notification, the underlying takedown notice will be treated as withdrawn.

​

We reserve the right to terminate accounts after fewer than two violations if warranted by the circumstances and our business judgment.

​

Intent to Comply

It is our express intent to comply fully with the DMCA and to limit liability to the fullest extent permitted under applicable law.
